How do I know if I can make a claim for my cycle accident?
If you have been involved in an any incident whilst riding your bike that was not your fault and you have suffered an injury or losses as a result, you may be able to make a claim for compensation. Typical examples include being hit by another vehicle, hitting a pothole or road works, perhaps a pedestrian or loose animal ran out in front of you and you crashed avoiding them.
The driver that hit me was not insured, or is untraced, can I still get compensation for my cycle accident?
Yes, if the accident was not your fault and you have been involved in a road traffic accident with an uninsured or untraced driver, we will claim on your behalf from the Motor Insurer’s Bureau. The MIB deals with claims arising from uninsured or untraced drivers and provides a source of compensation when there is no insurer to claim from.
How long will my cycle claim take?
The timescale of any claim usually depends on the extent of your injuries. If you have suffered minor injuries and recover quickly your claim may be concluded within a few weeks – months. If your injuries are of a more serious nature, it could take considerably longer. It is important that the full impact of your injuries is taken in to account to ensure that you get the maximum compensation for your accident.
I am unable to work due to my injuries, can I get an interim payment?
Once the defendant has admitted liability it is usually possible to negotiate an interim payment to bridge the gap until your claim is concluded, this payment is part of your award and will be deducted from your final settlement.
I use my bike to get to work, since my accident I have to pay for the bus, can I claim for this?
Yes, any out of pocket expenses that you incur as a result of your cycle accident can be claimed for. You may also be able to claim for the expenses of any 3rd parties that assist you, for instance travelling to hospital or other journeys, care and assistance and their additional expenses that are a result of your accident.
Do I need to go to court?
It is always more practical and quicker for both parties to try and sort things out by negotiation rather than rushing into court proceedings. If your case goes to court, it may not even be necessary for you to attend, however should you need to attend Court we will always be there to advise and organise representation for you.
Can I claim for damage to my bike?
Yes, any damage to your bike, helmet and anything else damaged as a result of your accident are part of your claim and you will be compensated for the cost of repair or replacement of those items.
How long after my cycle accident can I claim compensation?
You can still make a claim for any cycle accident up to three years after the date of the accident. If you were under 18 at the time of the accident you can make a claim up to 3 years after your 18th birthday.
